This document contains the general terms and conditions on the use of the flower delivery service (Service) by users (Users) available under the www.fleurop.hu domain (Website) operated by Fleurop Magyarország Kft. (hereinafter “GTC”).

Before finalizing your order, please read the provisions of these GTC carefully and use our services only if you agree with all its points and consider them binding on you. By finalizing your order, you unconditionally accept the provisions of these GTC.

The technical information required for the use of the Website, which is not included in these GTC, are detailed in the other information available on the Website.

Purchasing on the Website presupposes the User's knowledge and acceptance of the purchase by electronic means, in particular with regard to the technical possibilities and limitations, as well as the possibility of errors.

By finalizing the order, you acknowledge that the order establishes a contractual relationship (Contract) with the Service Provider and that the provisions of these GTC are mandatory when using the Service.

All those who place an order through the Website, as well as those who browse the Website without placing an order, are considered Users.

If you have any questions about these General Terms and Conditions, the use of the Website, the individual products, the process of purchase, or if you have a specific need, please contact our Customer Service!

These GTC are valid from 29 July 2020 for an indefinite period of time or until revoked / amended.
The Service Provider is entitled to unilaterally amend these General Terms and Conditions by informing the Users in advance via the Website. The Service Provider shall publish the information 15 days prior to the entry into force of the amended GTC. The amended provisions will take effect upon the User's first use of the Website with respect to subsequent orders and further use of the Website upon entry into force. The terms and conditions of these GTC remain in force as long as the Service Provider operates the Website, or in the event of the termination of the Website, until contractual fulfillment of pending orders, as well as for the duration of warranty claims.

In matters not regulated in the GTC, the effective Hungarian legislation shall prevail, in particular Act V of 2013 on the Civil Code, Act CVIII of 2001 on electronic commerce services and information society services; and Government Decree 45/2014 (II.26.) on the detailed rules of contracts between consumers and businesses. If any provision of this GTC or the Contract is unlawful or void under Hungarian law, or both, such provision or provision shall be separate from the other provisions, which shall remain in full force and effect. The invalidity of any provision of the GTC or the Contract shall not result in the invalidity of the GTC and / or the Contract, unless it is clear that without the invalid provision the Parties would not have concluded the Contract.

The Service Provider reserves the right to unilaterally change the range and type of products available on the Website. The Service Provider reserves the right to terminate the provision of the Services and the operation of the Website at any time, without giving reasons, and to refuse access to them. The Service Provider excludes liability for any damages resulting from changes in the conditions of operation of the Website or termination of the operation of the Website.

Use of the Website

The content of the Website is available to any User, no registration is required to view the content.

The Website is protected by copyright. The Service Provider is the copyright owner of the contents displayed on the Website (especially any visual, audio and textual content, the displayed graphics / editing, etc.). The User is not entitled to use these contents for his own purposes (copying, publishing, reproducing, reworking, etc.) such use may only take place with the prior written permission of the Service Provider.

The Service Provider reserves all rights to all elements of the Website, with special regard to the search engines and other Internet software, the domain name of www.fleurop.hu, the subdomains, subpages and internet advertising spaces belonging to it.

Users may use the Website at own risk. The Service Provider excludes its liability for all pecuniary and non-pecuniary damages arising during or arising from the use (excluding damages intentionally caused, or damaging life, bodily integrity or health).

When using the Website, the User is obliged to act in good faith and fairly and to refrain from any conduct that may directly or indirectly infringe the rights of third parties or the law.

The Service Provider makes every effort to ensure the continuous operation of the Website, but it is not guaranteed that the Website will not be unavailable due to maintenance or other reasons. Service Provider excludes its liability for data loss resulting from the non-continuous operation of the Website.

Placing Orders

Available products:

Information on the essential features of the products that can be purchased on the Website is provided in the descriptions of each product. You can access the individual product categories and each product by clicking on the product categories and each product on the website.

By clicking on each product, you will find a photo of the product, a description, the available sizes and the related prices. When ordering, you must pay the price for the selected size.

When selecting products, please observe the conditions described in the "Flowers" section below.

The prices indicated in the product characteristics are in Hungarian Forints and include the amount of VAT prescribed by law. There is no extra packaging fee! The delivery fee is usually HUF 2,400 within Hungary and HUF 3,000 abroad. If the delivery address is more than 20 km away from the nearest partner florist, the Service Provider is entitled to charge an additional HUF 1,500 delivery fee, in which case the Service Provider will indicate this to the User individually on a short notice.

In the event that an obviously incorrect (unrealistically low or incorrectly calculated) price appears next to a product in the fleurop.hu website, not indicated as a special price, the Service Provider is not obliged to deliver the product at the incorrectly indicated price, but may offer the product at the actual, real price. In such case the User may, in his sole discretion, decide to order the product at the real price or cancel the order without any consequences.

Delivery date:

After selecting the product, it is possible to enter the delivery date. When determining the delivery date, please observe the conditions described in the "Delivery" and "Shipping & Returns" sections below.

Add more products:

After entering the delivery date, by clicking on the Continue button, the system will offer the possibility to add additional products, failing which, by clicking on the Continue button, the contents of the basket can be accessed.

Finalize basket contents:

Placing in the basket does not constitute an offer and therefore does not in itself give rise to a purchase or payment obligation. You can add any number of products to the basket. Additional products can be accessed by clicking the "Continue Shopping" button, the product in the basket can be removed by clicking the "Remove This Product" button. By clicking on the "Next" button, the User will be redirected to the Specify delivery terms surface with the given shopping cart content.

Specify delivery terms:

In the Specify delivery terms surface, the recipient's data (surname, first name, address, telephone number, in the case of a company, company name, registered office, tax number, telephone number), individual accompanying cards and texts, preferred delivery period can be set. Clicking the "Go to Payment" button will redirect the User to the Billing Information and Order Overview surface.

Billing information and order overview:

In the Billing Information and Order Overview surface, the billing information (customer information: last name, first name, address, phone number, e-mail address (for a company, company name, registered office, tax number, phone number, e-mail address)) should be entered, and also the payment method can be selected. The surface also provides a detailed overview of the order and the amounts to be paid (including the price of the selected products and the delivery fee separately), while also providing the possibility of modification before finalization. In addition, it is possible to validate a discount coupon on this surface. When choosing a payment method, please observe the conditions described in the "Payment Terms" section below.

By clicking on the "Order" button, the order becomes final and the User is redirected to the payment surface of his choice. Please make sure that the data entered is correct before clicking the "Order" button.

After pressing the "Order" button, it is no longer possible to change the order. If you still notice any errors afterwards, please contact our Customer Service via e-mail or phone!

Checking and correcting data entry errors:

The User can check and modify the order data (product change, payment method, billing address, etc.) at any time before clicking the "Order" button during the order, by clicking the "Back" button, in addition, the Billing data and order overview surface provides full overview and possibility to modify the data provided.

It is the User's responsibility to ensure that the information provided by him is correct and true, the order is fulfilled and invoiced on the basis of the information provided by the User. Service Provider excludes its liability for performance resulting from incorrect data. The Service Provider reserves the right to pass on the damages resulting from the incorrect data entry to the User.

Please also note that if the e-mail account provided to confirm the order is unavailable (full storage space, etc.), the lack of confirmation may result in the failure of the Contract.

Billing and order confirmation:

Invoices for incoming orders and confirmation are sent automatically.

The confirmation e-mail contains the data provided by the User during the sending of the order: the order number, the data of the ordered product, the chosen payment method, the User's comments related to the order.

The order and its confirmation shall be deemed to have been received by the Service Provider or the User when it becomes available to him.

If the confirmation is not received by the User within 48 hours from the sending of the order, the User is released from the obligation of offer and is no longer obliged to purchase the product.

Unfortunately, technical errors may occur, so if you do not receive a confirmation email, please contact our Customer Service.

Incoming orders are processed (forwarded to florists) on working days from 9 am to 5 pm, on Saturdays from 10 am to 1 pm. It is also possible to place the order outside these times (i.e. at night or on weekends), in which case the processing will take place on the next working day. In such case the Service Provider undertakes to forward the order to the florist performing the delivery on the consecutive working day without delay (in the case of a bank transfer payment method, counted from the receipt of the payment).

Contract

The Contract is considered an electronically concluded contract.

An order sent by the User (providing of data) qualifies as a purchase offer by the User. The User is bound by his offer for a period of 48 hours. If the Service Provider does not confirm the User's offer within 48 hours in accordance with these GTC, the User shall be released from the obligation of offer.

The Contract is concluded by the confirmation of the order by the Service Provider (when the confirmation e-mail becomes available to the User).

Due to the unique nature of the products offered in the Website, the Service Provider reserves the right to reject or initiate changes of the confirmed order - if it cannot be fulfilled due to a reason arising during the order processing (i.e. the ordered flowers are not available no replacement product can be provided) -within 48 hours of start of processing the order (Orders are processed on weekdays from 9 am to 5 pm, on Saturdays from 10 am to 1 pm). The Service Provider shall immediately notify the User of the rejection of the order or its modification by a short notice, usually by telephone, or in case of failure thereof, by e-mail.

The Service Provider also reserves the right to withdraw from the contract if the User chooses the bank transfer payment method, however, he does not pay the full purchase price of his order to the Service Provider within 3 working days from the conclusion of the contract.

The User is entitled to cancel the order without any legal consequences until the confirmation e-mail becomes available for him. In this case, please send an e-mail to our Customer Service with your order details stating that "I cancel the indicated order".

The Service Provider informs the User that the contract concluded through the Website does not qualify as a written contract, they are not filed by the Service Provider, so the Contract will not be available afterwards. The Service Provider also informs the User that a contract can only be concluded in Hungarian language through the Website.

Behavior codex

The Service Provider does not have a code of conduct governing its service activities.

Delivery

Thanks to our unique worldwide marketplace we can deliver your order within hours anywhere in the world! Due to the various time zones & public business hours in individual countries, same day delivery on the date of your order can only be guaranteed under the following conditions:

  • Deliveries are performed by the partner florist shops of the Service provider.
  • order can be seen individually depending upon receiving-country under holidays and office hours.
  • Orders place outside of customer service hours are processed and delivered on the following working days (in absence of later delivery date) as per the delivery deadline rules.
  • The delivery period indicated by the User within a given delivery date, are considered a preferred period, which is not guaranteed. If delivery is not completed in the preferred period than User shall not be entitled to claim damages.
  • We cannot guarantee deliveries on Saturday afternoons or on Sundays and public holidays.
  • Campgrounds, military bases, boats, sea ports or airports are not guaranteed delivery addresses
  • Only delivery times for funerals can be guaranteed. The sender is therefore requested to give the time of delivery, as accurately as possible, in the “Delivery details” field of the order form.
  • For deliveries to hospitals, please indicate ward and room number whenever possible.The delivery is only granted to the reception desk of the hospital.
  • For deliveries to hotels, please indicate room number and name of the guest(s) (group, couple, etc.).The delivery is only granted to the reception desk of the hotel.

We may not be able to deliver to the city of your choice. In this case we will inform you as soon as possible and, if you have already paid for the product, we will refund it to you immediately.

Please check carefully that the delivery address, including local telephone number, is complete and correct. We cannot accept any liability for late or non-delivery due to an incorrect or incomplete address.

For special orders or inquiries please contact us. Deliveries guaranteed for a fixed time can only be executed with the prior agreement of our customer service department.

In the absence of the addressee, our florist member will attempt delivery and leave a calling card and try to reach the recipient later by phone.
If the florist is unable to deliver the flowers and unable to reach the recipient wihtin 24 hours after the first attempt of delivery, the florist will inform us of the none-delivery and you’ll be informed either via phone or Email that no delivery could be made.
The florist making the delivery is authorized to leave the flowers with a reliable third-party (e.g. a neighbour, receptionist, porter, funeral parlour, etc.) deemed suitable for passing on the flowers to the addressee.
The same applies to additional items (accompanying card, gift article, etc.) for which transmission has been agreed to in individual cases.

If the recipient refuses to accept the flowers without any reason, the full charges are due, and will be billed by our florist.

Flowers

Flowers are seasonal products, and some varieties will therefore not always be available. Furthermore, based on the fact that the flowers are fresh cut, it is possible that certain ingredient of the chosen bouquet is not at stock, therefore substitution is allowed. In case of shortage of certain flowers, the Service provider retains the rights to delivery a product similar in quality, style, shape, content and size.

We are unable to guarantee permanent availability of specific flowers at every florist shop worldwide, especially if orders are received at short notice. A Fleurop-Interflora bouquet may thus look slightly different to that shown in the Website. However, every Fleurop-Interflora bouquet is a work of art, freshly composed especially for you in one of our premium Fleurop-Interflora shops, and you may rest assured that every effort will be made to match the colour and shape of the bouquet shown in the Website.
Florists will prepare unique bouquets, which are products prepared for especially the Users, therefore there are no identical compositions. Naturally, the addressee will receive a product which is similar in style, shape and size in the most possible extent, to what was indicated on the picture as ordered by the Users.

Flowers are delivered without a vase, unless otherwise indicated.

Guarantee

Customer satisfaction is for our affiliated Florist very important. The guarantee assures you that all orders are handled by experts and are of first-rate quality. All flower arrangements will be fresh and delivered personally.

We guarantee the conscientious fulfilment of every Fleurop-Interflora order. Our guarantee comprises:

  • delivery of the ordered product by the florist
  • in fresh and perfect condition
  • on the requested date
  • at the price offered by Fleurop-Interflora florists and the website on the day of delivery.

Nevertheless, should there be any complaint, the addressee can of course contact the delivering Fleurop-Interflora florist. The latter guarantees the delivered product for 72 hours after delivery - with respect to quality, and will replace the product with another one if the flowers or plants that are the subject of any claim are returned to the shop within this period.

This guarantee is your assurance that your order will be executed with love and care, and that only the highest quality products will be used. However, should you not be satisfied with the delivery or quality, please let us knowwithin 72 hours latest from the date of delivery.

All orders are handled and processed exclusively by members of the Fleurop-Interflora organization.

Needless to say, all information required to process your order will be treated confidentially and will not be passed on to third parties.

Shipping & Returns

The acceptance of your order can be seen individually depending upon Interflora flowershop under holidays and office hours

Only delivery times for funerals can be guaranteed. The sender is therefore requested to give the time of delivery, as accurately as possible, in the “Delivery details” field of the order form.

We cannot guarantee deliveries on Saturday afternoons or on Sundays and public holidays

For deliveries to hospitals, please indicate ward and room number whenever possible.The delivery is only granted to the reception desk of the hospital.

For deliveries to hotels, please indicate room number and name of the guest(s) (group, couple, etc.).The delivery is only granted to the reception desk of the hotel.

Terms of Payment

Payment by credit card at our online store is made possible with OTP Bank’s secure card acceptance system using SSL encryption protocol. When paying with a card, you will be redirected to OTP Bank’s payment site, which means that the transaction itself takes place on a site operated by the Bank in accordance with the requirements and security regulations of international card companies, rather than at our online store. We will thus be unable to access or otherwise acquire your card details or data of the pertaining bank account, in any form. Be sure to have your card ready.

  • In order to complete your payment, you will need the following information: Card Number (A 13 to 19-digit number embossed or printed on the front of your card.)
  • Expiration Date (A date in mm/yy format, embossed or printed on the front of your card.)
  • Card Verification Code (The last 3 digits in the signature area on the back of the card [CVV2 or CVC2]. If your card does not carry a Verification Code, you will need to leave the pertaining field on the payment site blank.)

We currently accept the following cards:

  • Visa® (embossed)
  • MasterCard® (embossed)
  • American Express® (embossed)
  • Electronic (unembossed).

Acceptance of this card type for online purchases is subject to the issuing bank. In case the bank issuing your Electronic card authorised its use for online purchases, you are welcome to use it in our store. For more details, please contact your bank.

Naturally, all cards issued by OTP Bank are accepted.

Maestro®
All Maestro cards are accepted at OTP Bank’s online payment site regardless of the issuing bank. As the only condition for acceptance, your issuing bank must also support the use of Maestro cards in e-commerce transactions. Before making a purchase, you are advised to consult with your bank.

In order to further enhance the security of online card use, OTP Bank has introduced its Verified by Visa/MasterCard Secure Code (VbV/MSC) service. This entails the issuing bank providing the cardholder with an additional means of identification that gets verified during the transaction, thus accurately confirming the identity of the card’s user.

If your issuing bank does not offer any VbV/MSC services, or you have not requested it, the payment process will remain unchanged. Our store will redirect you to OTP Bank’s site, where you will need to enter your card details (card number, expiration date, verification code), after which payment for the purchased items/services takes place.

If VbV/MSC services are available at your issuing bank, and you have opted in, the payment process will be different. You will still need to enter your card details (card number, expiration date, verification code) via the OTP Bank payment site. After this step, however, you will be automatically redirected by the Bank to the appropriate site of your issuing bank, where you will need to have your identity confirmed.

Once your identity has been successfully confirmed, the payment transaction will resume and you will get a notification after it has completed.

As the last step, you will be redirected to our online store. If you are unable to have your identity confirmed, the transaction will be cancelled.

Supplies warranty, product warranty

Please note that due to the fact that bouquets of flowers are unique, perishable products, you can claim your warranty within 72 hours of delivery. We would also like to draw your attention to the fact that in the case of fresh cut flower bouquets and other flower products, section 6:158 of the Civil Code does not apply.

Supplies warranty

In what cases can you exercise your right to supplies warranty?

In the event of faulty performance by the Service Provider, you may assert a warranty claim against the Service Provider in accordance with the rules of the Civil Code.
Faulty performance is defined as the service not meeting the quality requirements set out in the contract or legislation at the time of performance. The obligor will not perform erroneously if the obligee was aware of the error at the time of concluding the contract or should have been aware of the error at the time of concluding the contract.

What rights do you have based on your supplies warranty claim?

You can choose to have the following supplies warranty claims:
You can request a repair or replacement unless it is impossible to meet your chosen claim or would incur a disproportionate additional cost to the Service provider compared to other way of satisfaction. If you have not requested or could not have requested a repair or replacement, you may request a pro rata reduction of the fee or you may have the defect repaired by someone else at the expense of the Service provider, or you may repair it, ultimately, withdraw from the contract.
You can transfer from your chosen supply warranty to another, but you will bear the cost of the transfer, unless it was reasonably necessary or if necessitated by the act of the Service provider.

What is the deadline for you to enforce your warranty claim?

You must report the defect immediately after discovering it, but no later than 72 hours after delivery. After this time, due to the short lifespan of the fresh cut flowers, you can no longer exercise your warranty rights.

Against whom can you assert your warranty claim?

You can assert your supply warranty claim against Fleurop Magyarország Kft.

What are the other conditions for enforcing your warranty rights?

Within 72 hours of performance, there are no conditions other than the notification of the faulty performance to enforce your warranty claim if you certify that the product or service was provided by Fleurop Magyarország Kft.

Product warranties

In what cases can you exercise your product warranty rights?

In the event of a defect in a movable thing (product), you may, at your option, assert a supplies warranty claim or a product warranty claim.

What rights do you have based on your product warranty claim?

As a product warranty claim, you may only request the repair or replacement of a defective product.

In which case is the product considered defective?

A product is defective if it does not meet the quality requirements in force at the time of placing on the market or if it does not have the characteristics specified by the manufacturer.

What is the deadline for you to enforce your product warranty claim?

You can assert your product warranty claim within two years of the product being placed on the market by the manufacturer. Upon expiry of this period, you shall lose this right.

Against whom and under what other conditions can you assert your product warranty claim?

You can only make a product warranty claim against the manufacturer or distributor of the product. You must prove the defect of the product in the event of a product warranty claim.

In which cases is the manufacturer (distributor) released from its product warranty obligation?

The manufacturer (distributor) is only released from his product warranty obligation if he can prove that:

  • the product was manufactured or marketed in the course of his non - business activities, or
  • the defect was not recognizable in the light of current scientific and technical knowledge at the time of placing on the market, or
  • the defect of the product results from the application of legislation or a mandatory official regulation.

It is sufficient for the manufacturer (distributor) to prove one reason for the exemption.

Please note that due to the same error, you cannot claim a supplies warranty and a product warranty at the same time, in parallel. However, if your product warranty claim is successfully enforced, you can assert your warranty claim against the manufacturer for the replaced product or repaired part.

After sales customer service and other services, guarantee

Our customer service is available on working days, at the contact details detailed in the “Complaint Resolutions” section below.

On the fleurop.hu website, it is possible to register as a user in the "Login" menu on the main page. Registration can facilitate future orders, as in this case the customer data or previous orders are saved and loaded automatically for the next order. In addition, special occasion dates can be set to which the system can send an automatic alert if required.

The Service Provider does not undertake a guarantee, there is no statutory guarantee for the products sold by the Service Provider.

Complaint Resolutions

The User may communicate his or her complaints related to the product or the activities or omissions of the Service Provider orally or in writing at the following contact details:

The Service Provider shall, if possible, investigate and remedy the verbal complaint immediately.

If it is not possible to remedy the oral complaint immediately, due to the nature of the complaint, or if the User does not agree with the resolution of the complaint, the Service Provider shall record the complaint in minutes.

The Service Provider shall immediately provide a copy of the minutes to the User in the event of a verbal complaint communicated in person.

In the event of an oral complaint communicated by telephone or other electronic communication service, the Service Provider shall send a copy of the minutes to the User at the same time as the substantive reply, the latest.

In all other cases, the Service Provider shall act in accordance with the rules applicable to written complaints.

The Service Provider provides a unique identifier to a complaint recorded by telephone or other means of communication, which simplifies the retrieval of the complaint later.

The Service Provider will respond to the complaint received in writing within 30 days and will arrange for its communication (send it by post, send it by e-mail).

If the complaint is rejected, the Service Provider shall inform the User of the reason for the rejection.

The Service Provider keeps the minutes for 5 years.

The record of the complaint (minutes) shall include at least the following:

  • a) the name and address of the consumer,
  • b) the place, time and manner of submitting the complaint,
  • c) a detailed description of the consumer's complaint, a list of documents, documents and other
  • evidence presented by the consumer,
  • d) a statement of the Service Provider on its position on the consumer's complaint, if it is possible to investigate the complaint immediately,
  • e) the signature of the person who took the minutes and, with the exception of an oral complaint made by telephone or other electronic means, by the consumer,
  • f) the place and time of recording the minutes,
  • g) in the case of an oral complaint made by telephone or other electronic communications service, the unique identification number of the complaint.

If any consumer dispute between the Service Provider and the User is not resolved during negotiations / negotiations with the Service Provider, the User who qualifies as a consumer may apply to the Conflict Resolution Body competent according to his place of residence or stay and the Service Provider's registered office.

Complaints to the consumer protection authorities: if you notice a breach of consumer's rights, you have the right to lodge a complaint with the competent consumer protection authority competent based on your place of residence. Initiation of court proceedings: The User is entitled to enforce his / her claim arising from a consumer dispute before a court in civil proceedings pursuant to Act V of 2013 on the Civil Code and Act CXXX of 2016 on the Code of Civil Procedure.

Online Dispute Resolution Platform: On the website set up by the European Commission, consumers have the opportunity to settle their online shopping disputes through filling an application, avoiding litigation.

Right of withdrawal according to Government Decree 45/2014:
In view of the fact that the products distributed by the Service Provider are perishable, non-prefabricated, custom-made products, as well as they are prepared by the Service Provider (partner florist) on the basis of the User's order and instruction, the Users are not entitled to Right of withdrawal according to the Government Decree 45/2014 (II.26.).
